This is an English translation of the General Terms and Conditions provided for informational purposes only. In the event of any discrepancy between the Czech and English versions, the Czech version shall prevail.
These General Terms and Conditions (hereinafter "GTC") govern the use of the AKCElerátor platform, operated by MMI, s.r.o., with its registered office at Matěchova 127/3, 140 00 Prague 4, Czech Republic, Company ID: 61856231, e-mail: [email protected] (hereinafter "Operator" or "AKCElerátor").
Through the AKCElerátor platform, Buyers may purchase Products offered by third parties (hereinafter "Sellers"). AKCElerátor acts as an intermediary for the sale based on a contract with the respective Seller and provides the technical solution for ordering, payment, and delivery of Products.
AKCElerátor does not provide the services or products that Sellers offer through the platform. The relationship between the Buyer and the Seller is direct and arises upon conclusion of the relevant contract (e.g. a contract for participation in an event, a contract for access to content, etc.). AKCElerátor acts solely as a technical intermediary for orders and payments, on behalf of and for the account of the Seller.
AKCElerátor is authorized by the Seller to collect the purchase price and is the designated entity for receiving and processing refund requests. The contractual relationship regarding the delivery of the Product arises between the Buyer and the Seller; however, AKCElerátor is responsible for the proper settlement of the payment transaction towards the Buyer.
Payments for Products are collected by AKCElerátor on behalf of the Seller and subsequently transferred to the Seller in accordance with contractual terms. Tax documents for purchased Products are issued by the Seller, not by AKCElerátor.
The Buyer selects a Product on the platform, specifies the quantity, and completes the payment using available payment methods (e.g. online card payment, bank transfer, etc.). Upon completion of the order, the Buyer receives a confirmation by e-mail or other chosen method.
The Product is delivered to the Buyer electronically without delay after the payment is processed. In the case of video recordings that are still being processed at the time of purchase, the estimated delivery date is indicated in the offer before the order is completed.
The Buyer is responsible for the accuracy of the contact details provided (in particular the e-mail address). AKCElerátor is not liable for non-delivery of order confirmations, Products, or other communications due to incorrect details, a full mailbox, spam filter settings, or other obstacles on the Buyer's side.
Product prices are displayed on the platform as set by the Seller. Whether prices include or exclude VAT depends on whether the Seller is a VAT payer. Price information including any applicable VAT is displayed to the Buyer before completing the order.
AKCElerátor may charge a service fee for transaction intermediation in addition to the Product price. The amount of the service fee is displayed to the Buyer before completing the order. The service fee covers transaction processing costs and is non-refundable in the event of Product cancellation or withdrawal from the contract.
For Products with recurring delivery (e.g. club membership, subscriptions), the Buyer authorizes recurring card charges at regular intervals set by the Seller (e.g. monthly) upon the first payment.
The Buyer may cancel recurring payments at any time through the platform or by sending a request to [email protected]. Cancellation takes effect at the end of the current subscription period — the Buyer retains access to the Product until then. No further charges will be made after cancellation. The amount paid for the current subscription period is non-refundable.
AKCElerátor will notify the Buyer of upcoming charges in accordance with the requirements of the applicable payment method.
Consumers generally have the right to withdraw from a contract concluded at a distance without giving a reason within 14 days of the conclusion of the contract. However, due to the nature of the Products offered through the platform, this right does not apply in the following cases. Withdrawal requests may be submitted electronically to: [email protected].
The Buyer acknowledges that, in accordance with Section 1837(j) of Act No. 89/2012 Coll., the Czech Civil Code, the right of withdrawal does not apply to contracts for leisure activities provided at a specified time or period. Therefore, the 14-day right of withdrawal without giving a reason does not apply to the purchase of event tickets.
Before accessing digital content, the Buyer expressly consents to the delivery of digital content before the expiry of the withdrawal period and acknowledges that, in accordance with Section 1837(l) of the Czech Civil Code, they thereby lose the right of withdrawal. The Buyer is prompted to give this consent before completing the order.
For Products with recurring delivery, the right of withdrawal is governed by the same rules as for digital content under Article 5.2. The Buyer may cancel recurring payments at any time in accordance with Article 4.3, whereby the subscription ends at the expiry of the current subscription period.
In the event of cancellation of an event or demonstrable non-delivery of prepaid digital content, the Buyer is entitled to a refund of the amount paid. Refund requests are processed by AKCElerátor. The amount will be returned to the Buyer's original payment method without undue delay after the cancellation or non-delivery of the Product by the Seller is confirmed, in accordance with the complaints procedure under Article 7.
All responsibility for the provision of the Product, its content, quality, and any changes or cancellations rests solely with the Seller.
In the event of cancellation of an event or non-delivery of a Product, AKCElerátor ensures the refund of the amount paid to the Buyer in accordance with Articles 5.4 and 7 of these GTC.
The Buyer has the right to file a complaint if the purchased Product was not delivered, does not correspond to the description on the platform, or has other defects preventing its proper use.
Since payments for Products are collected by AKCElerátor, AKCElerátor is the entity responsible for handling complaints towards the Buyer and the relevant payment institutions, unless otherwise agreed with the Seller.
Complaints may be filed exclusively electronically by sending an e-mail to: [email protected]
A complaint must include:
AKCElerátor is obliged to resolve the complaint within 30 days of its receipt. The Buyer will be informed of the outcome by e-mail.
Upon receiving a complaint, AKCElerátor will:
In the case of a valid complaint, AKCElerátor will ensure a remedy, in particular by refunding the amount paid or providing a replacement in agreement with the Buyer and the Seller.
Complaints regarding the actual content, quality, or conduct of an event or other Seller's performance should be directed to the Seller. AKCElerátor may, at the Buyer's request, assist in communication with the Seller.
The Buyer is obliged to protect their login credentials for the platform and not share them with third parties. The Buyer's account is non-transferable.
In the event of unauthorized sharing of access credentials or access to paid content, AKCElerátor reserves the right to block or delete the Buyer's account without entitlement to a refund.
AKCElerátor makes reasonable efforts to ensure continuous availability of the platform. However, AKCElerátor reserves the right to temporarily interrupt platform operations for maintenance, updates, or technical modifications, without the Buyer being entitled to compensation.
AKCElerátor is not liable for the inability to access a Product (in particular live streams and video recordings) caused by circumstances on the Buyer's side, including insufficient internet connection, incompatible software or hardware, or the Buyer's network settings.
In the event of a technical outage on the platform's side that prevents the Buyer from using a purchased Product (in particular a live stream), AKCElerátor will, in cooperation with the Seller, ensure an appropriate remedy, such as providing access to a recording or issuing a refund.
AKCElerátor shall not be liable for failure to perform or delayed performance of its obligations under these GTC if such failure is caused by force majeure, i.e. extraordinary, unforeseeable, and insurmountable obstacles arising independently of AKCElerátor's will. Force majeure includes, in particular, natural disasters, pandemics, armed conflicts, energy or telecommunications infrastructure outages, decisions of public authorities, and similar events.
In the event of force majeure, AKCElerátor will inform Buyers without undue delay and make reasonable efforts to minimize the impact on Buyers. Buyers' claims for refunds in such cases are governed by Article 7 of these GTC.
A Buyer who is a consumer has the right to out-of-court resolution of a consumer dispute arising from these GTC. The entity responsible for out-of-court consumer dispute resolution is the Czech Trade Inspection Authority (ČOI), with its registered office at Štěpánská 567/15, 120 00 Prague 2, Czech Republic, website: https://www.coi.cz.
The Buyer may also use the Online Dispute Resolution platform established by the European Commission at: https://ec.europa.eu/consumers/odr.
Before initiating out-of-court dispute resolution, AKCElerátor recommends that the Buyer first use the complaints procedure under Article 7 of these GTC.
By completing a purchase on the platform, the Buyer confirms that they have read and agree to these GTC, as well as the Seller's terms, which are accessible before completing the order.
For Products containing digital content, the Buyer expressly consents before completing the order to the delivery of digital content before the expiry of the withdrawal period and acknowledges that they thereby lose the right of withdrawal pursuant to Section 1837(l) of the Czech Civil Code.
If any provision of these GTC is or becomes invalid, ineffective, or unenforceable, the validity, effectiveness, and enforceability of the remaining provisions shall not be affected. The parties undertake to replace the invalid, ineffective, or unenforceable provision with a new provision that best corresponds in content and purpose to the original provision.
These GTC are valid and effective from the date of their publication on the AKCElerátor platform.
